It strikes me that collaborative law in divorce seems to be professional-driven, not client-driven. From what I've observed, it's the burned out litigators who seem to be driving the market, attempting to create demand where none exists. Or is it just me? |

Collab Practice |

Well, at one level, Collab Practice is a wise branding choice for those of such instincts . . . but it surely can be argued that capable counsel, whatever they call themselves, should be able to be collaborative. What is interesting is that certain recommended formulas seems to develop for how people can best be collaboratively taken care of. I think it is the representational aspect that is still most important, and the fact that there really is no designated mediator to best manage the process. Good that we have such experimentation. It will be interesting whether Collab Practice survives and whether it spreads beyond the family realm.

Obviously there is some traction, if only with professionals.

I recently completed some research in the area of collaborative law. Collaborative law is a big deal in Texas, Texas being the first state to adopt a statute recognizing the use of the process. The process, as indicated by many writers, is the way of the future for handling divorce cases. Described as a "peaceful process" and a "kindler and gentler" way of working through a divorce, I can't help but wonder about the emotional, highly conflicted couple. Will the model really work for them? |

The model won't work for everybody. Some folks just need their day in court. As much as I think that CL is lawyer-driven, not client demand driven, I do think it's a great idea for clients who need more structure than mediation but who see the futility of the litigation route. |
